How Maine child support law works

Legal starting point. Maine’s child-support law uses a basic-support table and an income-shares allocation. The table supplies a weekly baseline, while the court worksheet addresses the family’s income, care arrangement, expenses, and any reason to vary the presumptive result. Read Maine Title 19-A §§ 2001 and 2006.

How the guideline is calculated

The basic amount is matched to the parents’ combined annual gross income and number of children, then apportioned by income share. Substantial care, child care, medical expenses, insurance, and deviations require the related Maine forms and worksheets.

What this site’s worksheet covers

Uses Maine FM-084 basic support table only. Childcare, medical expenses, health insurance, supplemental worksheets and deviations are separate from this base worksheet. The table gives a weekly basic support amount per child; this module multiplies by the number of children and allocates the total by the paying parent’s share of combined annual gross income.

Documents that make the worksheet more useful

FM-040 worksheet, FM-050 affidavit, and supplemental substantial-care worksheet where required. Gather the records that support the income, parenting-time, insurance, child-care, and other adjustment entries that apply to the family. The base module still needs reconciliation of income-share rounding, substantial-care handling, and the full worksheet.

For a filing or agreement, complete the official court forms linked on this page. They use the same guideline structure explained here, and the court applies it to the facts of the case.

Before you enter your numbers

Is Maine's weekly table amount for the whole family?

Maine's table expresses basic support per child per week. Section 2006 directs the user to choose the column for the total number of children and multiply that per-child figure by the number of children. The table lookup uses combined annual gross income; child care, coverage, and substantial-care adjustments come in additional steps.

Prepare this: Keep annual income totals clearly labeled and complete the official FM-040 worksheet. If substantial care applies, retain the supplemental calculation with the base worksheet.

Read the relevant official instructions: Maine section 2006: support obligation and substantial care.

These preparation notes explain one part of the state guideline. A new estimate does not change an existing order; a modification request does.

How Maine cases actually get to a number

Match combined annual gross income and child count to the weekly basic amount, then apportion by income share. Medical support and child care are not buried in the table.

Maine uses a basic-support table keyed to combined annual gross income and an income-shares allocation, with additional forms when care is substantial in both homes. That is a different path from neighboring states that use another model, so do not import a table, percentage, or overnight credit from somewhere else.

Parenting time in Maine

Substantial care in both homes moves Maine onto additional worksheets. A primary-residence table amount is the wrong starting document for a true shared-care family.

Costs Maine usually treats separately

  • Child-care costs
  • Health-insurance premiums
  • Uninsured medical expenses
  • Other medical-support items on the Maine forms

When Maine courts leave the guideline

The table is a baseline. Best-interest and statutory deviation factors can change the result, but they are findings, not silent discounts.

Official Maine forms to keep beside this guide

FM-040 worksheet, FM-050 affidavit, and supplemental substantial-care worksheet where required. The base module still needs reconciliation of income-share rounding, substantial-care handling, and the full worksheet. The primary authority is the published Maine source. Fill the official form from source documents. Use this page only to check that you chose the right Maine path—primary versus shared, table versus percentage, add-ons versus basic support.

Questions specific to Maine

Why is the Maine table weekly if income is annual?

The table converts combined annual gross income into a weekly basic obligation. Keep the units straight.

Does Maine count overtime?

Regular overtime can be income. Sporadic overtime needs a case-specific average or exclusion.

Is there a separate medical-support form?

Medical support is often handled alongside basic support on the related Maine worksheets. Do not skip it.

Example: weekly table, annual income

Two children, $50,000 in annual gross income for each parent, ordinary primary care, and no expense additions or special adjustments.

  1. Combined annual income is $100,000; the closest FM-084 row is $100,200.
  2. That row’s two-child column is $196 per child per week.
  3. Multiply by two children: $392 per week in basic entitlement.
  4. The paying parent’s 50% income share is $196 weekly, equivalent to $10,192 annually or about $849.33 monthly.

The table amount is per child and weekly, even though the income used to look it up is annual. Substantial care, low-income reserve treatment and child-related expenses need additional worksheet steps.
