How Virginia child support law works

Legal starting point. Virginia Code section 20-108.2 uses a monthly basic-support schedule and an income-shares approach. The schedule provides the starting amount from combined monthly gross income, while the statutes and worksheets address custody, expenses, and deviation factors. Read Virginia Code § 20-108.2.

How the guideline is calculated

The parents’ combined gross income and child count select the basic obligation, then each parent is assigned a proportional share. Health coverage, child care, unreimbursed medical costs, sole, shared, or split custody, and deviations require the appropriate Virginia worksheet.

What this site’s worksheet covers

Uses Virginia Code § 20-108.2 schedule of monthly basic child support obligations for sole-custody base support. Health care coverage, child care costs, unreimbursed medical expenses, split custody, shared custody and deviation factors are separate worksheet issues.

Documents that make the worksheet more useful

Virginia DC-637, DC-638, or DC-640 for sole, split, or shared custody. Gather the records that support the income, parenting-time, insurance, child-care, and other adjustment entries that apply to the family. The calculator applies the guideline formula described above and identifies any listed worksheet line it does not compute.

For a filing or agreement, complete the official court forms linked on this page. They use the same guideline structure explained here, and the court applies it to the facts of the case.

Before you enter your numbers

Are Virginia custody days always the same as overnights?

Virginia's shared-custody provision defines qualifying days and addresses circumstances involving less than a full 24-hour period. The shared method is relevant when each parent has more than 90 qualifying days. A rounded overnight percentage can therefore miss the statutory counting and comparison steps.

Prepare this: Keep the actual calendar, exchange times where relevant, and separate child-care and coverage costs. Complete the custody-day count under the statute before choosing the worksheet.

Read the relevant official instructions: Virginia section 20-108.2: custody calculations.

These preparation notes explain one part of the state guideline. A new estimate does not change an existing order; a modification request does.

How Virginia cases actually get to a number

Enter combined monthly gross income, look up the table for the number of children, and allocate by share. Shared custody uses the statutory 20-108.2 shared-custody calculation, which is not half of sole custody.

Virginia Code section 20-108.2 uses a monthly combined-gross-income schedule (the ‘guidelines table’) and a statutory formula for shared-custody support. That is a different path from neighboring states that use another model, so do not import a table, percentage, or overnight credit from somewhere else.

Parenting time in Virginia

Virginia’s shared-custody guideline applies when each parent has the child more than 90 days of the year. Day-counting follows the statute. A 2-4-5-5 plan should be converted into statutory days, not vibes.

Costs Virginia usually treats separately

  • Work-related child-care costs
  • Health-care coverage
  • Unreimbursed medical expenses
  • Life-insurance to secure support when ordered

When Virginia courts leave the guideline

Deviation factors are in § 20-108.1. A child’s needs and imputed income may require findings. Income above the table has an express percentage formula in § 20-108.2(B); that calculation is separate from a discretionary departure.

Questions specific to Virginia

What is the 90-day test?

Shared-custody guidelines generally apply when each parent has more than 90 days. Count days as the statute counts them.

Gross or net?

The table is combined monthly gross income.

Income above the table?

For combined monthly gross income above $42,500, § 20-108.2(B) adds a percentage of the excess to the $42,500 table amount: 2.6% for one child, 3.4% for two, 3.8% for three, 4.2% for four, 4.6% for five, and 5.0% for six. This site does not calculate that branch and withholds an amount above the table; use the official worksheet.
